Surrogacy

Surrogacy is an arrangement where a woman agrees to carry and deliver a child for another person or couple, often due to infertility, health risks, or other factors. There are two main forms of surrogacy: traditional surrogacy and gestational surrogacy.

1. Traditional Surrogacy:

• Definition: The surrogate mother is biologically related to the child because her egg is used in the process.
• Procedure: The surrogate’s egg is fertilized using artificial insemination with sperm from either the intended father or a donor.
• Legal and Emotional Considerations: Traditional surrogacy can be more complex legally and emotionally since the surrogate is the child’s biological mother.

2. Gestational Surrogacy:

• Definition: The surrogate has no genetic connection to the child. An embryo created via IVF (In Vitro Fertilization) using the intended parents’ or donors’ egg and sperm is implanted in the surrogate.
• Procedure: The surrogate carries the pregnancy to term, but the child’s genetic material comes from the intended parents or donors.
• Prevalence: This is the more common type of surrogacy today due to the reduced legal complications, as the surrogate has no biological ties to the child.

Surrogacy Process and Details:

1. Screening and Contracts: The surrogacy process involves rigorous medical, psychological, and legal screenings. The parties sign detailed contracts outlining responsibilities, rights, and financial arrangements.
2. Medical Procedures: For gestational surrogacy, IVF is performed to create embryos that are then transferred to the surrogate’s uterus. In traditional surrogacy, artificial insemination is typically used.
3. Compensation: Surrogates often receive compensation, which covers medical costs, living expenses, and additional fees for carrying the child.
4. Legal Aspects: Laws vary widely by jurisdiction. Some places permit commercial surrogacy, where the surrogate is paid, while others only allow altruistic surrogacy (no financial gain). Contracts must address parental rights, custody, and post-birth processes.

Ethical and Social Considerations:

• Ethics: Critics argue about the potential exploitation of women, especially in commercial surrogacy. Supporters highlight the benefits for intended parents.
• Global Perspective: Surrogacy laws differ globally. Countries like the United States (in certain states), Ukraine, and Georgia allow commercial surrogacy, while it is banned in many European countries.

Each form of surrogacy has distinct legal, medical, and ethical implications that intended parents and surrogates must carefully navigate.
